Consider the following: The agency where you report the fraud can affect your entitlement to a reward. Only the Department of Justice (DOJ) reward programs pay rewards, and the average reward under the DOJ program for military fraud is $320,000. Rewards have hit close to $50 million in a single case. Conversely, there is no reward for reporting fraud directly to the Department of Homeland Security. 

 

In addition to rewards, there are other significant differences between the DOJ reward program and reporting fraud directly to Homeland Security.

 

Why File Directly Through an Attorney?

In some cases, whistleblowers do not want awards. There are times they simply want to report fraud. Using the example above, however, the only way to ensure the DOJ opens an investigation is to file under the DOJ reward program. To be eligible, the FCA requires that an attorney file in federal court alleging the complaint and serving the complaint upon the U.S. DOJ. By law, the DOJ must investigate every complaint filed under the FCA reward statute to determine the merits of the case.  

 

Another benefit of filing directly through an attorney is that when the DOJ receives the complaint, they will know an attorney has investigated the fraud allegations, prepared the complaint, and gathered material evidence in support of the complaint. This will determine the scope of the DOJ’s investigations. What’s more, it means your attorney is placing their reputation on the line and that they are aware of the caliber of the complaint. 

 

Also by law, the DOJ must inform your attorney of the results of the FCA investigation involving Homeland Security fraud allegations—but only if you file for a reward under the DOJ program. In those cases, your attorney will regularly communicate with the DOJ attorney and can offer assistance in the investigations. 

 

File Under the DOJ Reward Program?

The only way to ensure the government investigates your complaint is to file for the reward under the DOJ reward program. Under that same program, you will be entitled to learn the results of the investigation and receive a portion of the rewards collected.  

 

There are many benefits and drawbacks of filing rewards. All programs are different, and a thorough review is generally necessary. Being a whistleblower is demanding and can take a great deal of time and energy; plus, your identity will eventually be made known for reporting the fraud.
